Terms of Service

Scope of services

Finova Solutions provides done-for-you customer operations services for trades businesses, primarily in Australia. This includes AI-powered phone reception, lead capture, job booking, follow-up communications, and related customer operations functions as agreed in your service plan. The specific deliverables for your engagement are described in your plan and any supporting documentation provided at onboarding.

Services are delivered remotely. We configure, build, and operate the system on your behalf. You do not need technical knowledge to use the service.

Engagement and billing

Engagements operate on a rolling month-to-month basis. There is no fixed-term contract and no lock-in period. Your monthly plan fee is billed at the start of each rolling month once your AI reception system is live and taking calls. You are not charged the monthly fee during the setup period.

A one-time setup fee applies and is billed in milestones tied to each component going live. The setup fee and monthly plan fee applicable to your engagement are confirmed in writing before any billing takes place.

You may cancel at the end of any calendar month by providing written notice before the next billing date. No penalty applies for cancellation. Monthly fees already invoiced and paid are non-refundable for the period already delivered.

Client responsibilities

You agree to provide accurate business information during onboarding, including your trade category, service area, pricing guidelines, and booking process. The accuracy of the information the AI reception system provides to your customers depends on the accuracy of what you provide to us.

You are responsible for ensuring that the use of our services does not breach any licence, regulation, or obligation that applies to your trade or business. You maintain responsibility for the jobs your business takes on and for the quality of the trade work performed.

You agree to promptly review and act on bookings placed in your calendar by the system. The system is designed to capture and confirm, but the service relationship with your customers is yours.

Intellectual property

Finova Solutions retains ownership of the systems, software, and operational frameworks we use to deliver the service. Any configurations, scripts, or workflows built specifically for your business remain usable by you for the duration of the engagement.

You retain ownership of your customer data, your business identity, and any content you provide to us. You grant us a limited licence to use that material solely to deliver the agreed services.

Limitation of liability

To the extent permitted by law, Finova Solutions's total liability to you for any claim arising from or relating to these terms or the services will not exceed the monthly fees paid by you in the three months preceding the event giving rise to the claim.

We are not liable for indirect, consequential, or incidental losses, including lost revenue or lost opportunity, except where liability cannot be excluded by law. We do not guarantee that the service will capture every inbound enquiry or that every captured lead will convert.

Governing law

These terms are governed by the laws of Australia. Any dispute that cannot be resolved by good-faith discussion between the parties will be subject to the jurisdiction of the Australian courts.

Consumer guarantees under the Australian Consumer Law apply where applicable and cannot be excluded.

Changes to these terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will notify active clients by email before they take effect. Continued use of the service after the effective date of any change constitutes acceptance of the updated terms.
